These Terms and Conditions (“Terms”) govern the submission of property listings to U-Property PH (“we,” “us,” “our”) through our website. By submitting the property listing form, you (“Client,” “Seller,” “you”) agree to be bound by these Terms.
1. Data Privacy and Consent
By submitting your details, you consent to U-Property PH collecting, processing, storing, and using your name, contact information, and property details for the purpose of listing evaluation, marketing, and connecting you with prospective buyers or their agents. This is done in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and its Implementing Rules and Regulations.
We will not use your personal information for purposes beyond what is stated here without your further consent, and you may request access to, correction of, or deletion of your data at any time by contacting us directly.
2. Data Sharing
Your property details and relevant contact information may be shared with prospective buyers, our partner licensed real estate brokers, and marketing platforms as necessary to promote and facilitate the sale or lease of your property.
3. Data Retention
We retain your submitted information for as long as your listing remains active, and for a reasonable period afterward for record-keeping purposes, unless you request earlier deletion.
4. Authority to List
By submitting a listing, you represent and warrant that you are the legal owner of the property, or that you have been duly authorized by the owner to submit and manage this listing on their behalf. U-Property PH reserves the right to request proof of ownership or authority before publishing or continuing any listing.
5. Accuracy of Information
You are solely responsible for the accuracy, completeness, and truthfulness of all information submitted, including but not limited to price, property size, location, title status, and photos. U-Property PH is not liable for losses or disputes arising from inaccurate or misleading information provided by you.
6. Listing Fees and Broker’s Commission
Submitting and posting your property listing with U-Property PH is free of charge.
If your property is sold or leased as a result of a transaction facilitated through U-Property PH’s network of licensed real estate brokers, a broker’s fee of 5% of the final sold/leased price will apply, payable upon closing of the transaction. This fee compensates the licensed broker who facilitated the sale, in accordance with standard industry practice and applicable real estate brokerage regulations.
7. Non-Exclusive Listing
Listings submitted to U-Property PH are treated as non-exclusive unless a separate written exclusive listing agreement is signed. You remain free to market, list, or sell your property independently or through other platforms and agents while your listing is active with us.
8. Obligation to Update Listing Status
To keep our listings accurate and avoid displaying properties that are no longer available, U-Property PH may periodically reach out to confirm whether your property remains for sale or lease. You agree to promptly notify us once your property is sold, leased, reserved, or withdrawn from the market, so that we can update or remove the listing accordingly. Failure to update us may result in continued display of the listing until we can verify its status.
9. No Guarantee of Sale
U-Property PH makes no guarantee, express or implied, that your property will be sold, leased, or receive inquiries within any particular timeframe, or at all.
10. Right to Reject or Remove Listings
U-Property PH reserves the right, at its sole discretion, to decline, edit, suspend, or remove any listing that violates these Terms, contains inaccurate information, or is otherwise deemed inappropriate.
11. Limitation of Liability
U-Property PH acts as a listing platform and facilitator. We are not a party to any sale or lease transaction and are not liable for disputes, damages, or losses arising between you and any buyer, lessee, or broker, except to the extent caused by our own gross negligence or willful misconduct.
12. Amendments
We may update these Terms from time to time. Continued use of our listing services after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be subject to the exclusive jurisdiction of the appropriate courts.
